Terms & Conditions — Finland

These Terms & Conditions apply to customers in Finland and govern bookings made through SujanStudio.com. They include your 14-day right of withdrawal for distance contracts. Nothing in them limits the rights you have under Finnish consumer law.

1. Who these Terms apply to, and who you contract with

These Terms & Conditions ("Terms") apply where you book photography or videography services from Sujan Studio as a consumer resident in Finland. If you are booking in the course of a business, the sections dealing with the right of withdrawal and with consumer-specific protections do not apply to you.

Your contract is with Sujan Studio (ABN 13 680 271 434), of 135 Pirie Street, Adelaide SA 5000, Australia. We trade as Sujan Studio and you can reach us at support@sujanstudio.com or +61 3 6163 3896.

Nothing in these Terms excludes, restricts or modifies any right you have under the Finnish Consumer Protection Act (kuluttajansuojalaki) or other mandatory Finnish or EU law. Where any term conflicts with those rights, your statutory rights apply and the conflicting term does not.

2. The services

Sujan Studio ("we", "us", "our") provides professional photography and videography services, including:

  • Studio portraits
  • On-location shoots
  • Commercial and real-estate photography
  • Wedding and engagement photography
  • School, graduation and event photography

The specific services you are buying, the shoot date and location, the number of edited images or the length of video, and the delivery timeframe are set out in the confirmation we send you. That confirmation, together with these Terms, is the contract.

3. Booking and payment

3.1. How a booking is made

Requesting an estimate does not book anything and does not commit you to pay. A booking is made when you confirm the estimate and pay the deposit. We then send you a written confirmation setting out what you have booked. The contract is formed at that point.

3.2. Deposit

We ask for a deposit to reserve your date and time. The deposit is part of the price, not an additional charge, and is credited against the total. The balance is payable after we deliver your images or video, not before.

The deposit is a percentage of the agreed price, and the percentage depends on how far ahead of your shoot date you book: the further ahead you book, the smaller the deposit. It currently ranges from 10% for bookings made well in advance to 50% for bookings made close to the shoot date. The exact percentage, and the amount in euro, are shown on your estimate before you pay anything. If you have seen a flat figure quoted elsewhere on this site, the figure on your estimate is the one that applies.

3.3. If we do not deliver

If we do not attend the shoot, you owe us nothing and any deposit you have paid is refunded in full.

3.4. Prices

Prices quoted to consumers in Finland are shown in euro. The price on your estimate is the total price for the work described: it includes all taxes and unavoidable charges, and any travel or additional charge is itemised there before you confirm. The currency you will actually be charged in is shown to you at the checkout page before you pay. Your invoice sets out any tax charged on the payment.

We do not add charges after confirmation unless you ask us to change the booking and we agree the new price with you in writing first.

4. Your 14-day right of withdrawal

Because you book online or otherwise at a distance, you have a statutory right to withdraw from the contract within 14 days without giving any reason. This right comes from EU consumer law as implemented in the Finnish Consumer Protection Act, and we cannot take it away from you.

4.1. The withdrawal period

The 14-day period starts on the day the contract is concluded, which is the day we send your booking confirmation. If the last day falls on a Saturday, Sunday or public holiday, the period ends on the next working day. We send the confirmation, these Terms and the model withdrawal form below to you by email, so you have a durable copy of all three.

4.2. How to withdraw

Tell us in a clear statement before the 14 days expire — an email to support@sujanstudio.com is enough. You may use the model withdrawal form set out at the end of these Terms, but you do not have to, and any clear statement will do. It is enough that you send your notice before the period expires; it does not matter if it reaches us afterwards. We will confirm receipt in writing.

4.3. What happens when you withdraw

We refund everything you have paid, including the deposit, without undue delay and no later than 14 days after we receive your notice. We refund using the same means of payment you used, unless you expressly agree to something else, and you are never charged a fee for the refund itself. No cancellation charge under section 5 applies to a valid withdrawal. The only amount you can ever owe on withdrawal is the proportionate amount described in 4.4, and only in the circumstances set out there.

4.4. Shoots that fall inside the 14-day period, and what you pay if you change your mind

Your withdrawal period is 14 days, but some shoots are booked to take place sooner than that. If we simply waited out the 14 days we could not photograph a wedding next Saturday, and if we went ahead without asking you first, you would be entitled to withdraw afterwards and pay nothing for work we had genuinely done. So the law provides a way for you to ask us to start early, and it protects you when you do.

Where your shoot date falls inside the withdrawal period, we ask you for two things at the time of booking, as two separate tick boxes, neither of them pre-ticked:

  • Your express request that we begin performing the service before the 14-day period has expired.
  • Your acknowledgement that you will lose your right of withdrawal once we have performed the service in full, and that if you withdraw part-way through you will pay a proportionate amount for the work already done.

We record the wording you agreed to, the date and time, and store it with your booking. You can ask us for a copy at any time. If your shoot date is more than 14 days away, we do not ask you for either of these things, because we do not need to: your withdrawal right simply runs its course untouched.

4.5. What you pay if you withdraw after we have started

If you gave the express request in 4.4 and you then withdraw before the service is complete, you pay an amount proportionate to what we have actually supplied up to the moment you told us, measured against the full price agreed for the whole service. You pay nothing more than that: no cancellation fee, no penalty, and no charge for the part we have not done.

In practice, the work is in three parts — preparing and holding your date, carrying out the shoot, and editing and delivering the results. If you withdraw before the shoot day, you pay only for preparation actually carried out for you. If you withdraw after the shoot but before delivery, you pay for the preparation and the shoot. If you ask us, we will show you in writing how the amount was worked out, and we will refund the rest within the 14 days in 4.3.

If we did not obtain your express request and your acknowledgement, or we cannot show that we did, you pay nothing at all for work performed during the withdrawal period and your deposit is refunded in full, even if the shoot has already happened. That is the consequence the law attaches to getting this wrong, and we accept it.

4.6. When the right ends

Your right of withdrawal ends when the service has been performed in full — that is, when the shoot has taken place and the agreed images or video have been delivered to you — and then only if you gave the express request and acknowledgement in 4.4 before we began. Otherwise the right runs for the full 14 days regardless of what work has been done. Losing the right of withdrawal does not affect your rights in section 6 if something is wrong with the service.

5. Cancellation and changes outside the withdrawal right

This section applies where the 14-day withdrawal right in section 4 has ended or has been validly lost. It never overrides section 4.

5.1. If you cancel

You may cancel a booking at any time by telling us in writing. Cancelling more than 7 days before the shoot date is free and your deposit is refunded in full. Cancelling 7 days or less before the shoot date, we may retain from the deposit only what covers the costs we have actually incurred and the booking fee we have genuinely lost by holding your date. Anything above that is refunded to you.

If we are able to fill your slot with another booking, we refund the deposit in full or in the corresponding part. If you ask, we will tell you how the retained amount was worked out.

We will not charge you a cancellation amount for circumstances outside your control, including illness, bereavement, or an event that is cancelled or restricted by a public authority.

5.2. Moving your booking

You may move a booking to another date subject to availability. If you move it more than 7 days before the shoot, there is no charge and your deposit carries over.

5.3. If we cancel

If we cancel or cannot supply the service, we refund everything you have paid in full and without delay. This does not affect any further right you may have under Finnish law where our cancellation causes you loss.

6. If something is wrong with the service

The service must correspond to what was agreed and to what you can reasonably expect of professional photography or videography of this kind. If it does not, you have statutory remedies under the Finnish Consumer Protection Act. In outline, and without limiting those rights:

  • You may require us to correct the fault or re-perform the service at our cost and within a reasonable time.
  • If we do not, or cannot, you may require a reduction in price corresponding to the fault.
  • If the fault is material, you may terminate the contract and be refunded.
  • You may be entitled to compensation for loss the fault causes you.
  • You may withhold payment of a corresponding part of the price until the fault is put right.

These rights cannot be excluded or limited by these Terms, and nothing in section 10 affects them. Tell us as soon as you reasonably can after noticing a fault, and we will work with you to put it right.

7. Copyright, licence and attribution

7.1. Who owns the copyright

Copyright in the images and video remains with Sujan Studio and the photographer who created them. Buying a shoot buys you a licence to use the results, described below, not ownership of the copyright.

7.2. What your licence covers

On payment of the price, we grant you a licence to use the delivered images and video. Unless your confirmation says otherwise, that licence is: personal, private and non-commercial use; worldwide; for an unlimited period; non-exclusive; not transferable or sub-licensable; and it allows you to print, copy and share the files, including on your own social media.

7.3. Commercial use

If you need to use the images commercially — advertising, property listings, company marketing, resale, or use by a third party such as an agency or publisher — that is a commercial licence, and it is agreed separately. Tell us by email before the shoot what you need the images for. We will confirm the scope of the commercial licence and any additional price in writing before the shoot, so that what you pay matches the use you get. Where a shoot is by its nature commercial work — real estate, business, product or brand photography — the commercial use you told us about is included and we will confirm it in writing; you do not have to ask twice.

If we did not agree a commercial licence in writing and you use the images commercially anyway, we will not treat that as a breach without first contacting you and offering to agree a licence for that use.

7.4. Our use of your images

We do not use your images in our own marketing, portfolio, website or social media unless you have separately and specifically agreed to it. That consent is optional, is never a condition of booking, and you can withdraw it at any time by contacting us — we will then stop using the images going forward. Where other people are identifiable in the images, we also need their consent.

7.5. Attribution and integrity

The photographer has moral rights in their work under Finnish copyright law, including the right to be named as the author and the right not to have the work altered in a way that is prejudicial to them. Please do not present the images as your own work, and do not apply heavy edits, filters or crops that change the character of the work before publishing it. If you need to alter the images, ask us and we will usually agree in writing.

8. Delivery

  • We deliver digitally, by a download link or online gallery, within the timeframe stated in your booking confirmation.
  • Delivery timeframes differ by occasion. Real-estate work is typically delivered within 24 to 48 hours. Weddings, events and larger productions take longer, and we give you a firm date when you book. Whatever timeframe is written in your booking confirmation is the one that binds us; any figure given elsewhere on this site is an indication only.
  • If we are going to be late, we will tell you. If delivery is materially late, section 6 applies and you may set us a reasonable further deadline and, if we miss it, terminate and be refunded.
  • We keep the delivered files available for download for at least 12 months from delivery. We may keep them longer, but we do not promise to, so please download and back up your files when you receive them. After 12 months we cannot guarantee we can recover them for you.

9. Your responsibilities

  • Tell us about anything that affects the shoot — access, permissions, restrictions, timings, and anything you particularly want captured — before the shoot day.
  • Where the shoot is at a venue or a private location, please arrange permission for us to photograph there. Tell us if you are not sure and we will help.
  • Where other people will be photographed, please make sure they know a photographer will be present.
  • Give us safe and reasonable working conditions on the day.

10. Our liability

We are liable to you under Finnish law for loss we cause you. We do not limit or exclude our liability in any way for death or personal injury, for intentional or grossly negligent conduct, or for your statutory rights under section 6. Those cannot be limited and are not limited here.

Beyond that, and only to the extent it is fair and permitted by Finnish law, our liability for other loss arising from a booking is limited to the price of that booking. This limit does not apply where Finnish mandatory law gives you more.

Photography and video capture depend on equipment and on conditions on the day. If technical failure or loss of files means we cannot deliver what was agreed, we will re-shoot where that is possible, and otherwise refund you; section 6 sets out your rights in that situation.

11. Privacy and data protection

We process your personal data, including the photographs and video in which you and others are identifiable, in accordance with the General Data Protection Regulation and Finnish data protection law. Our Privacy Policy and Cookie Policy explain what we collect, why, how long we keep it, where it is stored and transferred, and how to exercise your rights of access, correction, erasure, objection and portability.

You may complain to the Finnish Data Protection Ombudsman (Tietosuojavaltuutetun toimisto) if you think we have handled your data unlawfully.

12. Complaints and dispute resolution

If something has gone wrong, contact us first at support@sujanstudio.com. We will acknowledge your complaint within 2 business days and give you a substantive response within 14 days.

If we cannot resolve it between us, you can get free advice and mediation from Consumer Advisory Services (kuluttajaneuvonta), run by the Digital and Population Data Services Agency, and you can refer the dispute to the Consumer Disputes Board (kuluttajariitalautakunta) for a recommended resolution. The Board normally requires that you have contacted us first. You can also contact the Finnish Competition and Consumer Authority (Kilpailu- ja kuluttajavirasto) and the Consumer Ombudsman.

Using any of these routes does not affect your right to take the matter to court.

13. Governing law and where a dispute is heard

These Terms are governed by Finnish law where you are a consumer resident in Finland. Whatever else these Terms or any other Sujan Studio document say, you keep the protection of the mandatory rules of the country where you live, and nothing here can reduce them.

You may bring proceedings against us in the courts of the place where you live in Finland, or where we are established. We may bring proceedings against you only in the courts of the place where you live.

14. Changes to these Terms

The Terms that apply to your booking are the ones in force on the day you made it. We may change these Terms for future bookings, and the version and date at the top of this page will tell you which version you are reading. We do not change the terms of a booking you have already made unless you agree, or unless a change is required by law.
